End User Licence Agreement
Last updated: 7 October 2026
PLEASE READ THIS AGREEMENT CAREFULLY BEFORE USING INCHGROVE. BY DOWNLOADING, INSTALLING, OR USING THE APPLICATION YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT INSTALL OR USE THE APPLICATION.
1. PARTIES
This End User License Agreement ("Agreement") is between you ("User" or "you") and Reuben Roberts ("Developer", "we", or "us"), the individual developer of the mobile and desktop application known as Inchgrove ("Application").
2. GRANT OF LICENSE
Subject to your compliance with this Agreement, the Developer grants you a limited, non-exclusive, non-transferable, revocable licence to install and use the Application on devices that you own or control.
You may use the Application for any purpose, personal or commercial. This includes use by a nursery, garden centre, landscaping or bonsai business, school, or other professional or institutional user, to manage collections belonging to you or to your organisation, and on the devices of your staff acting in that capacity.
What this licence does not permit is redistributing, reselling, or sublicensing the Application as supplied to you. Those restrictions are set out in Section 3.
This Agreement governs the built Application only. The source code from which it is built is licensed separately, to anyone who obtains it, under the GNU General Public License version 3 — which does permit modifying and redistributing it, on the terms that licence sets out. Nothing in this Agreement restricts any right you hold under the GPL in respect of the source code, and nothing in this Agreement is a condition on exercising it. Any build you make yourself from that source is yours under the GPL, not a copy of the Application supplied under this Agreement.
3. RESTRICTIONS
These restrictions apply to the Application as supplied to you under this Agreement. They do not apply to the source code, which is licensed under the GNU General Public License version 3 as described in Section 2, and they are not to be read as adding any condition to that licence.
You may not:
- a) copy, modify, adapt, translate, or create derivative works of the Application;
- b) reverse engineer, disassemble, decompile, or otherwise attempt to derive the source code of the Application, except to the extent expressly permitted by applicable law;
- c) sell, sublicense, rent, lease, lend, or otherwise transfer the Application or any rights in it to any third party;
- d) remove or alter any proprietary notices, labels, or marks on the Application;
- e) use the Application for any unlawful purpose or in violation of any applicable law or regulation.
4. EDITIONS, PRICE, AND TIPS
The Application is free of charge in every form it is distributed in. It places no limit on how many records you may store, and no feature is sold or locked behind a purchase.
- Store Edition
- obtained from an app store, such as Google Play or the Microsoft Store.
- Direct Edition
- obtained from the Inchgrove website or its official releases page: the Android package, or the Windows and Linux desktop builds.
- a) You may choose to support the Developer with a tip. A tip is a voluntary gift. It buys nothing: it unlocks no feature, changes nothing in the Application, and creates no entitlement, subscription, or obligation on the Developer's part.
- b) In the edition obtained from Google Play, a tip is paid through Google Play's billing, with RevenueCat presenting the amounts on offer. Google Play shows the price in your currency before you confirm. A tip is final and non-refundable except as required by applicable law or under Google Play's own refund policy.
- c) Other editions may instead link to the Developer's page on Ko-fi (ko-fi.com). A tip given there is made on Ko-fi's website under Ko-fi's terms, not through the Application, which takes no part in it and receives nothing from it.
- d) A Direct Edition should be obtained only from the Inchgrove website or its official releases page. The Developer cannot vouch for the integrity of a copy obtained from anywhere else.
- e) Installing an Android package directly requires you to permit installation from that source in your device settings, and your device may warn you before it proceeds. Whether to do so is your decision.
- f) The Developer may change or stop offering tips, or cease offering any Edition, at any time.
5. YOUR CONTENT
The records you create in the Application — trees, pots, species, care guides, diary entries, jobs, photographs, and videos ("Your Content") — belong to you. The Developer claims no ownership of Your Content and acquires no licence to it.
- a) You are responsible for Your Content, including for holding the rights necessary to store any photograph, video, or text you add to the Application.
- b) The Application can export Your Content to a file. If you choose to share an exported file, you are responsible for what it contains and for distributing it lawfully. Sharing is entirely under your control; the Application never transmits an exported file anywhere on its own.
- c) Content you import from a file supplied by someone else is merged into your own collection. The Developer does not review, endorse, or accept responsibility for content originating from third parties.
6. DATA STORAGE AND PRIVACY
The Application is designed on a local-first basis.
- a) All data you enter is stored on your device, in a database and photo files held in the Application's own storage. It is not transmitted anywhere except through the optional features described in this Section and in Sections 7 and 8, each of which is off until you switch it on. The update checks described in Section 10 send no part of it.
- b) The Application does not require an account and does not collect or store any personal information as part of its normal operation. The Developer operates no server holding your records and has no copy of your collection.
- c) You are solely responsible for maintaining backups of your data. The Application provides export functions for this purpose, including a full database snapshot on desktop. The Developer accepts no liability for data loss resulting from device failure, uninstallation, or any other cause.
- d) If you choose to export a job to your device calendar (see Section 9), the text of that job and the tree or collection it belongs to are written into a calendar entry, which leaves the Application's own storage and is thereafter held by your device's calendar. Where that calendar belongs to an account you have configured to synchronise — an iCloud or similar account — your operating system may replicate the entry to that account's servers, under that provider's terms rather than these. The Developer neither performs nor receives any such transfer. On Android the Application's calendar is created as a local, non-synchronising one. Export is off unless you turn it on, one job at a time.
- e) Frost warnings are off unless you turn them on in Settings. While they are on, the Application sends the name you type when choosing a town, with the Application's language, to GeoNames (geonames.org) to find it, and that town's position, rounded to about a kilometre, to the Norwegian Meteorological Institute (api.met.no) for its weather forecast. No tree, species, or identifier of you is sent, and the chosen town stays on the device you chose it on. Your IP address reaches each service as it would when contacting any server. Both services' data is used under the Creative Commons Attribution 4.0 licence and credited in the Application. A frost warning is general guidance derived from a forecast, not a guarantee of the conditions your trees will meet.
7. CLOUD BACKUP AND SYNC (OPTIONAL)
The Application can back up your collection to, and synchronise it between your own devices through, a Dropbox or Microsoft OneDrive account that you supply (the "storage provider"). This feature is disabled until you connect an account from the Backup & Sync screen.
- a) If you connect an account, a file containing your records and copies of your photographs and videos are uploaded to a folder in your own storage provider account.
- b) The data is held in your storage provider account, not by the Developer. The Developer has no access to it and does not receive a copy.
- c) The connection is authorised by you through the storage provider's own sign-in flow. The resulting access tokens are held in your device's secure credential store and are never transmitted to the Developer.
- d) You may disconnect at any time. The Application also provides an action to delete the backup held in your storage provider account. Disconnecting does not delete data already stored there; deleting the backup does not affect the copy on your device.
- e) The storage provider's own terms and privacy policy govern its handling of anything stored in your account. They are available at https://www.dropbox.com/privacy for Dropbox and https://privacy.microsoft.com/privacystatement for Microsoft OneDrive.
8. CRASH REPORTING (OPTIONAL)
The mobile Application includes an optional crash and performance reporting feature powered by Sentry (sentry.io). It is disabled by default and requires your explicit consent before it is activated (Settings > App > Anonymous crash reports). It is not present in the desktop version.
- a) If you enable it, diagnostic data — including crash stack traces, device model, operating system version, and app version — may be transmitted to Sentry's servers.
- b) Nothing is recorded or reported unless something goes wrong. Sessions in which no error occurs are not recorded. A small proportion of sessions additionally report timing measurements, which contain no recording and no content.
- c) When an error does occur, a replay of the interface in the moments leading up to it is included. This is a reconstruction of the screen layout, the navigation between screens, and where you tapped — not a video of the display. Text and images are masked, so the words in your diary entries and the content of your photographs do not appear in it.
- d) Your diary entries, tree records, photographs, and videos are not transmitted as part of a crash report.
- e) Your IP address reaches Sentry's servers in the course of sending a report, as it would when contacting any server. The Application does not attach it to the report, and Sentry is configured not to store it.
- f) You may withdraw consent at any time by disabling the toggle in Settings > App. The change takes effect the next time you open the Application.
- g) Sentry's own privacy policy governs Sentry's processing of any data transmitted to its platform and is available at https://sentry.io/privacy/.
9. DEVICE PERMISSIONS
The Application may request the following device permissions, each of which is used solely for the features described:
- Camera
- photographing and recording video of your collection, trees, pots, and species, and scanning printed QR labels.
- Photo Library
- adding existing photographs and videos to your records.
- Microphone
- recording the audio track of videos, and voice input for diary and job entries.
- Speech Recognition
- transcribing voice input into text.
- Notifications
- reminders for scheduled jobs and backup prompts. These are scheduled on your device; the Application has no push notification server and sends you nothing remotely.
- Exact Alarms
- on Android, delivering a job reminder at the time you set rather than at a time chosen by the system.
- Calendar
- adding jobs you choose to export to your device calendar. Granted only if you use that feature.
The Application creates and uses its own calendar, named "Inchgrove", and confines itself to that calendar: it adds, updates, and removes only the entries it created there for jobs you chose to export, and it does not read, list, or alter events in any other calendar on your device. Nothing from your calendar is transmitted anywhere.
Your operating system may present this as a single, broad calendar permission covering both reading and writing. That is the only tier the platforms offer an application that maintains a calendar of its own — a narrower write-only permission exists on recent iOS but cannot create or address a calendar, and Android offers no such tier at all. The limitation described in the preceding paragraph is a commitment by the Developer, not one enforced by your device. You may revoke the permission at any time; job export then stops working and nothing else is affected.
Speech recognition is carried out by your device's operating system or, in the desktop version, by the embedded browser engine. Depending on your platform, version, and settings, the audio may be transcribed on the device or sent to Apple's or Google's speech services for transcription. In either case it is handled by the platform and not by the Developer, who neither receives nor stores it. If you would rather no audio left your device, do not use the voice input feature.
Permissions may be refused or revoked at any time in your device settings; the feature that depends on the permission then stops working, and the rest of the Application is unaffected.
10. SOFTWARE UPDATES
The mobile Application, in either Edition, may check for and download updates automatically through Expo's update service, and apply them the next time it starts. This request discloses your IP address and your app and device version to Expo. No part of Your Content is involved.
Such updates cover part of the Application only. A change requiring a new installation package is not delivered this way: for a Store Edition it arrives through the platform store, and for a directly installed Android package you obtain and install the newer package yourself.
The desktop Application does not update itself. Updates are obtained by downloading and installing a newer version.
The desktop Application and the directly installed Android package can tell you when a newer version is released. Unless you turn this off in Settings, they fetch a small file listing the latest versions from GitHub (github.com) about once a day. The request carries no identifier and none of Your Content, though your IP address reaches GitHub as it would when contacting any server. Nothing is downloaded or installed by this check.
11. THIRD-PARTY SERVICES AND COMPONENTS
The Application integrates the following third-party services. Each is governed by its own terms and privacy policy, which you should review independently:
The Developer is not responsible for the practices of these third parties.
The Application also incorporates open-source software components, each licensed by its own author under its own terms. Nothing in this Agreement limits any right you have under those licences in respect of those components.
12. INTELLECTUAL PROPERTY
The Application, including its code, design, graphics, text, the built-in species catalogue, and the built-in care guides, is owned by the Developer and is protected by copyright and other intellectual property laws. Nothing in this Agreement transfers any ownership rights to you.
This Section does not apply to Your Content, which is dealt with in Section 5, or to the open-source components referred to in Section 11.
The licence granted in Section 2 is the only right you receive in connection with the Application.
13. DISCLAIMER OF WARRANTIES
THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER DISCLAIMS ALL WARRANTIES INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
The Developer does not warrant that the Application will be error-free, uninterrupted, or free of harmful components, or that defects will be corrected.
The horticultural information in the Application, including the built-in care guides, is general guidance only. It is not advice for any particular plant, and outcomes depend on species, climate, and conditions the Developer cannot assess. You remain responsible for the care of your trees.
14. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, REVENUE, PROFITS, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APPLICATION, EVEN IF THE DEVELOPER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
THE DEVELOPER'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING UNDER OR IN CONNECTION WITH THIS AGREEMENT SHALL NOT EXCEED THE AMOUNT, IF ANY, YOU PAID FOR THE APPLICATION.
Nothing in this Agreement excludes or limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot lawfully be excluded or limited.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, the above limitations apply to the fullest extent permitted by law.
15. TERMINATION
This Agreement is effective until terminated. It terminates automatically if you fail to comply with any of its terms. Upon termination, you must cease all use of the Application and delete all copies in your possession.
Termination does not delete Your Content from your own device or from any cloud account you have connected; removing it is a matter for you.
Sections 5, and 11 to 18, survive termination.
16. GOVERNING LAW AND DISPUTES
This Agreement is governed by the laws of England and Wales, without regard to its conflict of laws principles. Any dispute arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales.
If you are a consumer, you may also have rights under the mandatory consumer protection laws of your country of residence, which this Agreement does not affect, and you may be entitled to bring proceedings in the courts of that country.
17. CHANGES TO THIS AGREEMENT
The Developer may update this Agreement from time to time. The updated version will be made available through the Application, the Inchgrove website, or the applicable platform store listing. Continued use of the Application after the effective date of any change constitutes your acceptance of the revised Agreement.
18. ENTIRE AGREEMENT
This Agreement constitutes the entire agreement between you and the Developer with respect to the Application and supersedes all prior understandings, agreements, or representations.
